For the purposes of these terms and conditions, “Us”, “Our” and “We” refers to RemStoneTherapy.com and “You” and “Your” refers to you, the client, visitor, website user or person using our website and ‘Coaching’ refers to any training, mentor coaching and online courses. 

1.AMENDMENT OF TERMS

1.1 We reserve the right to change, modify, add or remove portions of these terms at any time. Please check these terms regularly prior to using our website to ensure you are aware of any changes. We will endeavour to highlight any significant or substantive changes to you where possible. If you choose to use our website then we will regard that use as conclusive evidence of your agreement and acceptance that these terms govern your and RemStoneTherapy.com’s rights and obligations to each other. 

2. LIMITATION OF LIABILITY

2.2 It is an essential precondition to you using our website that you agree and accept that RemStoneTherapy.com is not legally responsible for any loss or damage you might suffer related to your use of the website, whether from errors or from omissions in our documents or information, any goods or services we may offer or from any other use of the website. This includes your use or reliance on any third-party content, links, comments or advertisements. Your use of, or reliance on, any information or materials on this website is entirely at your own risk, for which we shall not be liable. 

2.3 It shall be your own responsibility to ensure that any products, services or information available through this website meet your specific, personal requirements. You acknowledge that such information and materials may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.

3.COMPETITION AND CONSUMER ACT

3.1 Our goods and services come with guarantees that cannot be excluded, modified or restricted under the Australian Consumer Law and are in addition to any manufacturer or supplier warranty.

3.2 For the purposes of Schedule 2 of the Australian Consumer Law, in particular Sections 51 to 53, 64 and 64A of Part 3-2, Division 1, Subdivision A of the Competition and Consumer Act 2010 (Cth), RemStoneTherapy.com’s liability for any breach of a term of this agreement is limited to: the supplying of the goods or services to you again; the replacement of the goods; or the payment of the cost of having the goods or services supplied to you again.

3.3 You must be over 18 years of age to use this website and to purchase any goods or services. 

4. DELIVERY OF GOODS

4.1 Physical goods may be delivered by Australia Post and/or other reputable courier companies. Deliveries are processed promptly upon receipt of full payment. Delivery may take between 2 and 14 days, depending on the delivery option. Damaged or lost orders should be resolved with Australia Post or the courier company directly and we are not responsible for goods that are damaged in transit or not received. Replacement of damaged or lost items is made at the discretion of RemStoneTherapy.com.

4.2 Digital goods are delivered immediately. Please be aware there are inherent risks associated with downloading any software and digital goods. Should you have any technical problems downloading any of our goods, please contact us so we may try to assist you.

5. RETURNS AND REFUNDS

5.1 RemStoneTherapy.com handles returns and processes refunds in accordance with the Australian Consumer Protection legislation.

5.2 Should you wish to return your order, please notify us within 7 days of purchase with a valid reason for return. If we are unable to resolve your complaint or further assist you, we will process a refund upon timely receipt of the goods purchased. Unopened goods will be refunded in full. Refunds will be processed promptly and payment made by the same method that you made payment. All refunds are made at the discretion of RemStoneTherapy.com.

5.3 In reference to digital training products, we provide a 14 day in full money back Happiness Guarantee. Please notify us within 14 days of purchase with a valid reason for not being happy with the training product.  This Happiness Guarantee will only be applied once the training product has been completed in full, including all lessons, video content and included workshops if applicable.   Our aim is to share and save massage therapists thumbs and wrists and to assist them towards optimal health and wellbeing.  If we are unable to resolve your complaint or further assist you with the happiness of our training products we will process a refund.  Please note this Happiness Guarantee is a one-time offer.

6.1 RemStoneTherapy.com may from time to time provide on the website, links to other websites, advertisements and information on those websites for your convenience. This does not necessarily imply sponsorship, endorsement, or approval or arrangement between RemStoneTherapy.com and the owners of those websites. RemStoneTherapy.com takes no responsibility for any of the content found on the linked websites.

6.2 RemStoneTherapy.com’s website may contain information or advertisements provided by third parties for which RemStoneTherapy.com accepts no responsibility whatsoever for any information or advice provided to you directly by third parties. We are making a ‘recommendation’ only and are not providing any advice nor do we take any responsibility for any advice received in this regard.

7.1 To the fullest extent permitted by law, RemStoneTherapy.com absolutely disclaims all warranties, expressed or implied, including, but not limited to, implied warranties of merchantability and fitness for any particular purpose.  RemStoneTherapy.com gives no warranty that the documents, goods or services will be free of errors, or that defects will be corrected, or that our website or server is free of viruses or any other harmful components. 

7.2 Whilst we, at all times endeavour to have the most accurate, reliable and up-to-date information on our website, we do not warrant or make any representations regarding the use or the result of the use of any document, product, service, link or information on the website or as to the correctness, suitability, accuracy, reliability, or otherwise. 

7.3 It is your sole responsibility and not the responsibility of RemStoneTherapy.com to bear any and all costs of servicing, repairs, or correction. We respect the privacy and confidentiality of the information provided by you and adhere to the Australian Privacy Principles. Please read our separate Privacy Policy carefully.

8.2 You may change your details at any time by advising us in writing via email. All information we receive from our customers is protected by our secure servers. RemStoneTherapy.com’s secure server software encrypts all customer information before it is sent to us. Furthermore, all customer data collected is secured against unauthorised use or access. Credit card information is not stored by us on our servers.

9. THIRD PARTIES

9.1 We do not and will not sell or deal in personal or customer information. We may however use in a general sense without any reference to your name, your information to create marketing statistics, identify user demands and assist in meeting customer needs generally. In addition, we may use the information that you provide to improve our website and services but not for any other use.

10.1 RemStoneTherapy.com may be required, in certain circumstances, to disclose information in good faith and where RemStoneTherapy.com is required to do so in the following circumstances: by law or by any court; to enforce the terms of any of our customer agreements; or to protect the rights, property or safety of our customers or third parties. 

11. EXCLUSION OF COMPETITORS

11.1 If you are in the business of creating similar documents, goods or services for the purpose of providing them for a fee to users, whether they be business users or domestic users, then you are a competitor of RemStoneTherapy.com.

RemStoneTherapy.com expressly excludes and does not permit you to use or access our website, to download any documents or information from our website or obtain any such documents or information through a third party. If you breach this term then RemStoneTherapy.com will hold you fully responsible for any loss that we may sustain and further hold you accountable for all profits that you might make from such unpermitted and improper use. RemStoneTherapy.com reserves the right to exclude and deny any person access to our website, services or information in our sole discretion. 

12. COPYRIGHT, TRADEMARK AND RESTRICTIONS OF USE

12.1 RemStoneTherapy.com is a registered Trademark entity.  All training, names of techniques, sequences, principles, content and this website contains material which is owned by or licensed to us. This material includes, but is not limited to, the design, layout, look, appearance, trademarks and graphics. You are not permitted to reproduce the documents, information or materials on the website, nor any training content for the purposes of sale or the use by any third party. In particular you are not permitted to republish, upload, transmit electronically or otherwise or distribute any of the materials, documents or products that may be available for download from time to time on this website. 

12.2 RemStoneTherapy.com expressly reserves all copyright and trademark in all documents, information and materials on our website and we reserve the right to take action against you if you breach any of these terms. 

12.3 Any redistribution or reproduction of part or all of the contents in any form is prohibited other than the following: you may print or download to a local hard disk extracts for your personal and non-commercial use only; and you may copy the content to individual third parties for their personal use, but only if you acknowledge the website as the source of the material.

12.4 You may not, except with our express written permission, distribute or commercially exploit the content. Nor may you transmit it or store it on any other website or other form of electronic retrieval system. 

13. WHOLE AGREEMENT

13.1 These terms and conditions represent the whole agreement between you and RemStoneTherapy.com concerning your use and access to RemStoneTherapy.com’s website and your use and access to the documents and information on it. No other term is to be included in this agreement except where it is required to be included by any legislation of the Commonwealth or any State or Territory. All implied terms except those implied by statute and which cannot be expressly excluded are hereby expressly excluded.

14.1 Where any clause or term above would by any applicable statute be illegal, void, or unenforceable in any State or Territory then such a clause shall not apply in that State or Territory and shall be deemed never to have been included in these terms and conditions in that State or Territory. Such a clause if legal and enforceable in any other State or Territory shall continue to be fully enforceable and part of this agreement in those other States and Territories. The deemed exclusion of any term pursuant to this paragraph shall not affect or modify the full enforceability and construction of the other clauses of these terms and conditions.

15. JURISDICTION

15.1 This agreement and this website are subject to the laws of Queensland and Australia. If there is a dispute between you and RemStoneTherapy.com that results in litigation then you must submit to the jurisdiction of the courts of Queensland.

Terms & Conditions For Coaching & Membership

1. REMSTONE THERAPY COACHING

Our Coaching Program is divided into Three Levels of Learning.  Our courses are thoughtfully designed to be sequential, ensuring a structured and effective learning journey. Each course builds upon the knowledge and skills acquired in previous levels, with certain courses having prerequisites to ensure you have the necessary foundation. This approach allows for a progressive development of both technique and theoretical understanding. Depending on your current level of experience and skill set, your training pathway will be tailored to meet your specific needs, ensuring you gain the most from each course. By following this sequential structure, we ensure that every massage therapist can achieve mastery at their own pace, ultimately leading to a comprehensive and well-rounded expertise. Please note the prerequisites for each course and refer to the Course Options sheet for benefits and inclusions. 

1.1 Level 1 – FOUNDATIONAL

This is the very first introduction to RemStone Therapy and for some, first time using stones as massage tool and is a prerequisite to all other coaching courses. It includes RemStone 101, Module 1 Equilpoise and Module 2 Remedial coaching courses.  Every massage therapist begins with RemStone 101 then can either continue with Module 1 or progress to next level to Module 2 – Remedial, depending on your preference, stoneskills and type of experience as a massage therapist. 

1.2 Level 2 – GROWTH

This next level is aimed at growing your stone skills once you have completed your foundational learning of RemStone Therapy. This level includes Module 3 Deep Tissue, Extension Course #1 Pregnancy, Extension Course #2 SpaStone.

1.3 Level 3 – MASTERY

This level is when all your stoneskills are eager to delve deeper and become the master you were always meant to be! This level includes Module 4 Triggafascia, Module 5 Sportzonal, Extension Course #3 AromaStone.

2. REMSTONE THERAPY MEMBERSHIP

Joining our membership program offers numerous high value benefits that greatly enhance your learning experience. 2.1 OPTION 1 allows you to purchase coaching courses individually with a one-time payment for lifetime access. It does not include membership benefits and is designed as a DIY, 'do it yourself' coaching solution. You’ll have access to premium content, enabling you to study and practice at your own pace. Please note the prerequisites for each course.

2.2 OPTION 2 allows you to purchase 6 months of Membership upfront at your desired study level. Unlike Option 3, which drip feeds the lessons of the course, this one-time payment grants you instant access to lessons and full access to the benefits of that Membership Level for 6 months access to The Hub. Please note the prerequisites for each course still applies and refer to the Course Options sheet for benefits and inclusions of this membership level.

2.3 OPTION 3 allows you to pay for your Membership level on a month-by-month basis. This monthly payment grants you access to the benefits of that Membership Level and all included lessons for the paid month. Your payment date will be the first day you are charged your Membership Fee, and this becomes your monthly renewal date. Each month runs from this date to the day before the next payment. You’ll have access to the online course you are currently learning and The Hub for your membership level. Please note, with Option 3, lessons are structured to roll out progressively each month, rather than being accessible all at once. 6. GAINING CPEs

For RemStone Therapy to inform your Massage Association about potential Continuing Professional Education (CPE) points:

1. You must fully complete a course with certification (includes workshops & video submissions), or be in person for a live webinar and obtain a certificate of completion/attendance.
2. You must complete the CPE request form on our website.

Please note, although we believe our courses should be included in all massage colleges due to their original premise and the way they address work, health, and safety issues for Massage Therapists, we cannot guarantee that your Association will issue Continuing Education accreditation.

7. EXCESSIVE USE OF COURSE CONTENT & SHARING YOUR LOGIN DETAILS

While all courses are available for lifetime access, we do monitor usage and occasionally update the format. We operate on a basis of trust, but as our product is trademarked, we take plagiarism seriously. Sharing your login details or providing free access to others is strictly prohibited. Honesty is key, and if you're found abusing this by sharing your login, you will be permanently banned. Creating and developing RemStone Therapy has required significant time and financial investment, and we offer it to you at a fraction of its true value.
